2. Purpose

These Terms of Use (hereinafter "Terms") govern access to and use of the Bugsy mobile application (hereinafter "the Application"), published by Rayane Benhizia.

Use of the Application implies full acceptance of these Terms. If you do not accept these terms, please do not use the Application.

3. Access to the Application

3.1 Technical Requirements

The Application is available on Apple's App Store for iOS devices. You must have:

An iOS-compatible device

An Apple ID and iCloud account

An Internet connection for certain features

3.2 Minimum Age

The Application is intended for users aged 12 and over. Minors under 18 must obtain authorization from their parents or legal guardians before using the Application.

3.3 Download

The Application is available for free download on the App Store. Internet connection and download fees remain your responsibility.

4. Account Creation

4.1 iCloud Account

The Application uses Apple's CloudKit to manage your account. You must be signed in to iCloud on your device to use the Application. No separate account creation is required.

4.2 Username

You must create a username that will be visible to your friends in the insect exchange feature. You agree to:

Choose an appropriate and respectful username

Not impersonate another person

Not use offensive, discriminatory or illegal terms

We reserve the right to delete any inappropriate username without notice.

4.3 Friend Code

The Application automatically generates a unique friend code to allow you to add other users (maximum 10 friends). This code is personal and should only be shared with trusted people.

5. Application Features

5.1 General Principle

Bugsy is a virtual insect collection application. Users earn stars (in-app credits) to unlock new insects through bubbles (random draws).

5.2 Earning Stars

Stars can be obtained in several ways:

For all users:

Daily insect quiz

Walking 5,000 steps per day (requires HealthKit access)

For GOLD accounts only:

Free daily star bonus

In-app purchases:

You can also purchase stars directly through the App Store

5.3 Insect Draws and Rarity System

Available Bubble Types:

The Application offers 4 types of draw bubbles, each containing insects of different rarity. The price of each bubble in stars is displayed directly in the Application and may be modified.

The drop rates for each Bubble type are displayed directly in the Application and may be modified. The current rates are always accessible in the Bubble information page.

Insect Rarity: The rarity of each insect is determined approximately according to its worldwide presence in nature.

Random Nature: Draws are entirely random according to the indicated probabilities. We do not guarantee obtaining a specific insect.

Duplicates: Only the Common Bubble can contain duplicates (insects already in your collection). Duplicates can be exchanged with your friends within 7 days.

5.4 Exchanges Between Friends

You can add up to 10 friends via their friend code. Exchanges of duplicate insects are possible for a period of 7 days after obtaining the duplicate. After this period, the duplicate disappears.

You agree not to:

Create multiple accounts to exploit the exchange system

Harass other users to obtain insects

Use fraudulent means to manipulate exchanges

5.5 AI Chat with Insects (GOLD Accounts Only)

Users with a GOLD account can chat with insects in their collection via Google's Gemini artificial intelligence. This feature is limited to approximately 50 messages per day.

Conversations are contextualized with:

Insect information

Current local weather

Recent conversation history

Important:

Conversations are generated by AI and may contain errors or unexpected responses

We are not responsible for AI-generated content

Conversations are saved locally on your device only

If you delete the Application, your conversations will be permanently lost

5.6 Insect Cards

Each insect has a detailed card with scientific and educational information. Local weather is displayed to indicate whether the insect would be active in these conditions.

6. Free and GOLD Accounts

6.1 Free Account

The free account offers access to basic features:

Insect collection

Daily quiz

Reward for 5,000 steps per day

Exchanges with friends

6.2 GOLD Account (Subscription)

The GOLD account is accessible via a paid subscription and offers:

Removal of all ads

Access to AI chat with insects (approximately 50 messages/day)

Free daily star bonus

All free account features

Subscription Terms:

Subscription is managed through your App Store account

Renewal is automatic unless canceled at least 24 hours before the end of the current period

You can cancel your subscription at any time in your App Store account settings

No refund is possible for the current period

Upon cancellation, you retain GOLD access until the end of the paid period

7. In-App Purchases

7.1 Star Packs

You can purchase star packs through the App Store. Purchases are final and non-refundable, except as required by law.

7.2 Payment

All payments are managed by Apple through the App Store. We do not have access to your banking information. Apple's payment terms apply.

7.3 Pricing

Prices for in-app purchases and GOLD subscription may be changed at any time. Price changes do not apply to current subscriptions.

8. Intellectual Property

8.1 Rights to the Application

The Application, its design, features, texts, images, insect illustrations, source code and all elements that compose it are the exclusive property of Rayane Benhizia and are protected by French and international laws relating to intellectual property.

8.2 License to Use

We grant you a personal, non-exclusive, non-transferable and revocable license to use the Application for personal and non-commercial purposes.

You agree not to:

Copy, modify, distribute or sell the Application or its content

Decompile, disassemble or attempt to extract the source code

Use the Application for commercial purposes without authorization

Create derivative applications

8.3 User Content

The username you create remains your property. By using the Application, you grant us the right to use this username in the context of the Application's operation (particularly for exchanges between friends).

9. Responsibilities

9.1 Application Availability

We strive to ensure the availability of the Application 24/7. However, we do not guarantee uninterrupted access and cannot be held responsible for:

Interruptions for maintenance

Technical failures beyond our control

Problems related to third-party services (CloudKit, Gemini AI, Firebase)

Malfunctions related to your device or Internet connection

9.2 Application Content

Information about insects (descriptive cards, characteristics, potential dangers, interactions with humans, ecological roles, etc.) is provided for strictly educational and informational purposes.

We disclaim any responsibility regarding:

The accuracy, completeness or timeliness of information

The consequences of using this information in real life

Any decision made based on this information

Important Warning: In case of contact with an insect in real life (sting, bite, allergic reaction, etc.), the Application's information does not replace the advice of a healthcare professional. Consult a doctor or emergency services immediately.

The Application is for entertainment and educational purposes only and does not constitute a medical or scientific reference guide.

9.3 AI Chat

Responses generated by Gemini AI are automatic and unpredictable. We are not responsible for:

Content generated by AI

Factual errors in responses

Any consequences related to the use of information provided by AI

You use the AI chat at your own risk.

9.4 Advertisements

Ads displayed via Google AdMob are managed by third parties. We are not responsible for the content of ads or the sites to which they may redirect.

9.5 Limitation of Liability

To the fullest extent permitted by law, our liability is limited to the total amount you have paid for the Application in the past 12 months.

10. User Obligations

You agree to:

Use the Application in accordance with these Terms and applicable legislation

Not attempt to hack, alter or disrupt the operation of the Application

Not use the Application to distribute illegal, offensive or harmful content

Not exploit technical flaws to gain an unfair advantage

Not create fake accounts or manipulate the rewards system

Respect other users in exchanges

Any breach of these obligations may result in suspension or deletion of your account without notice or refund.

11. Personal Data

The collection and processing of your personal data are governed by our Privacy Policy, which you accept by using the Application.

You have rights regarding your personal data in accordance with GDPR. For more information, consult our Privacy Policy.

12. Termination

12.1 Termination by User

You can stop using the Application at any time by uninstalling it from your device. To delete your CloudKit data, you must manage your iCloud storage in your device settings.

If you have a GOLD subscription, you must cancel it in your App Store account settings to avoid renewal.

12.2 Termination by Publisher

We reserve the right to suspend or delete your access to the Application in case of:

Violation of these Terms

Fraudulent or abusive use of the Application

Inappropriate behavior towards other users

Non-payment (for subscriptions)

In case of suspension or deletion due to user fault, no refund will be made.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will take effect upon publication in the Application.

In case of substantial modification, we will inform you via a notification in the Application. Continued use of the Application after modification constitutes acceptance of the new Terms.

If you do not accept the new Terms, you must stop using the Application.

14. Applicable Law and Jurisdiction

These Terms are governed by French law.

In case of dispute, we invite you to contact us first at rayanebenhizia@icloud.com to attempt to find an amicable solution.

Failing an amicable resolution, any dispute relating to the Application will be submitted to the competent French courts, in accordance with the applicable rules of jurisdiction.

15. Miscellaneous Provisions

15.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the use of the Application.

15.2 Partial Invalidity

If any provision of these Terms is deemed invalid or unenforceable, the other provisions remain fully in force.

15.3 Waiver

Our failure to exercise a right or provision of these Terms does not constitute a waiver of that right or provision.
